Article n°2 : Terms of payment

 

Generalities:

The price of articles is payable in cash the day of the signing of order.
The order validated by the customer will be considered as effective when the money will be credited on my account.
In case of refusal to pay of the bank, the order will automatically be cancelled.

 

- On-line payment by bank card, secured by Paypal (Avaible for Europe):

The banking information relative to the customer (number of bank card and date of validity) is coded by the secured protocol SSL then treated by PayPal.
Your data do not pass in transit by Marchand Medieval website, only PayPal can access to this informations.

- Payment by bank transfer (banwire) european and international.

Ordered articles are reserved only during 4 working days and they put in preparation in waiting for reception of the payment on my bank account.
Crossed this deadline of 4 working days, the order will be cancelled and ordered articles will be again available on sale on the website.

- Payment by check (France only):

 

If you live in France and have a french bank account, you can pay by french check.

Items ordered that are reserved for 3 days and placed in preparation for receipt of the check.
After the time of 3 working days, your order will be canceled and the items ordered will again be available for sale on the site.
Your order will be shipped upon receipt of the check to the account of marchand-medieval.com.

Article n°3 : Delivery

 

Place:

The sale of products proposed on the site is limited in Metropolitan France, FRENCH OVERSEAS DEPARTMENT, Corsica and in Monaco, in the countries of Europe and certain world countries.
The delivery of products is assured in all the countries served by my partners carriers.
Products are delivered to the delivery address indicated by the customer on his order form.

Postal charges:

Postal charges are automatically calculated, according to the weight of the parcel and its place of delivery.
You see postal charges when you add articles in the basket (choose your country).

Delais of delivery by post:

A order is considered as shippable from moment or all the selected products are shown well " in stock " in the summary of the basket.
If one of them is indicated " in resupplying " or "out of stock", the customer will have to take into account the additional deadline which is variable according to every articles.
The delivery deadline is a function of the availability of products during the order.
When the product marked " in stock ", the deliveries are realized within 5 working days.
In case of absolute necessity Marchand Medieval is unloading of is obligation to deliver: the war, the riot, the fire, the strikes, the accidents and the impossibility to be furnished or with quite other cause which escapes the control of the salesman.
The customer must to verify attentively his parcel on arrival during the delivery.
If the parcel have a trouble, make precise reserves with the carrier if a product misses or underwent a degradation.
I shall not proceed to a partial shippings because the shipping cost calculation is made on the basis of a single sending.
If however the customer wishes to accelerate the delivery by a partial sending of his order, he will have to make the request and to pay additional shipping cost.
I'm not responsible of the non respect with the deadlines of send of the post office.

Procedures of receipt of a parcel:

If you are not at home, you must to pick up your parcel to your post office.
You so have a deadline (according to your countries) to pick up your parcel to your post office before this one will be returned to the sender.
In case of return of the parcel, our customer service will get in touch with you to take the necessary measures of refund or forwarding.
In this case, the expenses of reforwarding will be chargeable to the customer.
Or, if  the customer prefer to be refund, the initial expenses of shipping will be chargeable to the customer and substract to the order amount.

Parcel delivered in poor condition:

The customer has to refuse the parcel by indicating on the delivery note the mention " refused parcel because damaged " and to email me quickly.
If the parcel presents evident tracks of opening, shocks and there is missing one or several articles, you also have to refuse it and make a report of despoliation with the Post office, you will send me back the report so that i proceed to the refund or to the exchange. If these procedures are not respected, Marchand Medieval gets free of any responsibility on possible refunds of products and transport.

Error of  address of the addressee:

The personal information written by the buyer during the creation of its account and during the taking of order commits this one: in case of error in the address  of the addressee, Marchand Medieval will be not responsible of the impossibility to deliver the product.
If the parcel or the letter comes back to me because of bad address, you will have to pay second time for shipping charges so that I can resend you your order to the good address.

 

Article 4: Marchand Medieval guarantees

 

The availability of articles:

- If the article is marked " in stock " the parcel can leave as soon as your payment is collected on my account.
- If certain articles display "to order" or " in the course of resupplying " contact me to know the deadlines.

Offers of products proposed on the site are valid only while stocks last. The majority of products proposed on Marchand Medieval  website are available in stock. If one time (by error) one or several ordered products were not in stock I shall contact you to cancel or modify your order.
The prices appearing on this website are indicated in euro, dollars, pounds.
Prices include VAT except expenses of delivery, and can vary in the course of the year.
My products stay my whole property until the complete payment of the price.

Right of retraction:

According to the code of the consumption of your countries, you have a deadline to return me an article which would not correspond to your expectations.
In case of exercise of the law of retraction, Marchand Medieval makes a refund to pay off your returned order (in 1 month),  in the form of a credit (to cost on the site on a future order) or in the form of a refund, from the return of the article and having judged the good state of or the articles.

If you have benefited from free shipping, Marchand Medieval substract of your refund  the shipping costs.

7 working days: Austria, Belgium, Bulgaria, France, Ireland, Lithuania, Luxembourg, Netherlands, Slovakia, Spain and United Kingdom
8 days: Hungary
10 days: Poland
10 days: Greece, Italy, Romania
14 days: Cyprus, Czech Republic, Denmark, Estonia, Finland, Germany, Portugal, Sweden, Latvia
15 days: Malta and Slovenia
There is currently no statutory right of withdrawal for distance selling to consumers in Switzerland.

How to exercise your right of retraction ?

Respect necessarily the deadline period of your countries: the deadline runs as from the day of the reception of the goods and up to the dispatch date indicated on the parcel of return.
Return necessarily the article in is original packing, without track of use or wear, by joining it possible accessories, notes of uses and a photocopy of the invoice with the motive for return.
The refund of the total amount of the order is made in thirty days following the arrival of the goods. The expenses of return stay however chargeable to the customer.

The law of retraction does not work in the following cases:

- An article having been damaged (tried, crossed off, torn, track of use) can be the object of no agreement of resumption, of exchange or refund.
If the customer send back the article in that case of exclusion of the law for the retraction, he will have to pay again shipping to recover his article.

- The not refund or resumed of a garment or a garment part, of fabrics having been embroidered by respecting the orders indicated by the customer during his order.

- The not refund of the provision of a service of drawing of embroidery respecting the orders indicated by the customer during his order.

- The not refund of a belt for which you asked to drill holes to your measures.

The totality of products sold on this site have no guarantee.
They are hand-made and answering no particular standard.

The vegetable dyes:

The vegetable dye is fragile and is not long-lasting in the time as chemical colours.
Colors stemming from a vegetable dye made in cauldron are unique, not reproducible and irregularities of tone ( clearer or darker tasks) can be present on the same part of textile because of a mode of hand-made work.
By buying a textile dyed in the vegetable dye, you accept the constraints bound to the nature of this process.
Conditions of use to protect longer your colors:
Wash in the hand in a temperature of 30-40°C maximum.
Never of washing powders or soaps presenting agents going pale in their composition! Prefer a soft liquid soap.
Drying shielded from the direct rays of the sun.

 

Article 5: Validity of the order

 

Once your registered order, an acknowledgement of receipt recapitulating your information of order, is sent to you on your email.
This acknowledgement of receipt is worth acceptance of your order and will validate the transaction.

At the time of the signing of his order, the customer recognizes to have acquainted with the particular conditions of sale written on this page and declares to accept them without reserve.

The particular conditions of sale can be corrected at any time and without advance notice. The applicable conditions will then be the ones current on the site during the validation of the order by the customer.

Marchand Medieval reserves the right to refuse any order of a customer with whom there would be a dispute concerning the payment of a previous order.

The fact of not having received the particular conditions of sale in its mother tongue do not dispenses at all the customer of their applications.

 

Article 6: Applicable Law

 

All the articles appearing in these present general conditions of sale, as well as all the operations of sale which are aimed at it, are subjected to the French law.
In case of dispute, the affair will be handled by Bourges commercial court in France.

 

Article 7: Invoicing

 

From your validated order, you receive an invoice by email under the shape of a file PDF. This invoice recapitulates all the articles ordered as well as postal charges. To save the paper and the nature, the electronic invoice is the solution chosen by Marchand Medieval.
