Article #2 : Terms of payment

 

General :

Payment is made at the time of ordering.
Once payment is cleared the order will be shipped on the next working day.

If payment does not clear, the order will be automatically cancelled.

- Payment by bank transfer (bank wire) European and international :

The goods are reserved for four working days to allow for transfer of the payment. If payment has not been received after four working days the order will be cancelled and the goods placed back on the website for sale.

Any fees incurred using this method of payment will need to be met by the purchaser.

 

 

- Payment by cheque (France only) :

 

If you live in France and have a French bank account, you can pay by French cheque.

The goods are reserved for three working days to allow for receipt of the cheque. If payment has not been received after three working days the order will be cancelled and the goods placed back on the website for sale.

Your order will be shipped once the cheque has cleared into the account of marchand-medieval.com.

Article #3 : Delivery

 

Location :

The sale of products from on the site is limited to Metropolitan France, FRENCH OVERSEAS DEPARTMENT, Corsica, Monaco, Europe and certain worldwide countries.

The delivery of products is assured in all countries served by my postal carriers.

Products are delivered to the delivery address given by the customer on the order form.



Postal charges :

Postal charges are automatically calculated, according to the weight of the parcel and its delivery location.

You see postal charges when you add goods to the basket once you select your country.

 

Special cases :

For heavy packages and/or exceeding the size accepted by mail, parcel will be sent by special carrier.

In these cases the shipping costs will change from those stated on the website according to the package, delivery location and carrier used.

A quotation for the shipping costs in these cases will be given on request and are indicated in the item description.

 

Free postage :

For France, postal charges are free above 200€ of goods (except using a discount coupon and for a maximum 5 kg).

 

For Europe, postal charges are free for some countries from 250€ of goods (except when using a discount coupon and for a maximum 5 kg).

A list of countries given this offer of free postage:

United Kingdom, Northern Ireland, Germany, Belgium, Luxembourg, Netherlands, Austria, Spain, Italy, Portugal, Switzerland, Guernsey, Isle of Man, Jersey.

 

For other countries in Europe and worldwide, postal charges are free for some countries from 300€ of goods (except when using a discount coupon and for a maximum 3 kg).

Delivery times :

All items shown ‘in stock’ will be shipped on the working day (Monday – Friday) following payment. These should then be delivered in 5 working days after shipment.

Items that show ‘resupplying’ or ‘out of stock’ will be shipped once they are available; the amount of time will then vary according to the item. Please request a timescale for delivery.

Partial shipping of orders that contain ‘in stock’ and ‘out of stock’ items will be made on request from the customer as extra shipping charges will apply.

In the event of circumstances beyond the control of Marchand Medieval, for example, postal strikes; every effort will be made to deliver your goods within a reasonable time.

Parcels should be checked by the customer on receipt of the goods and, in the first instance, any damage to be raised with the carrier.


Receiving a parcel :

Parcels will be delivered according to your country’s normal procedures. If you are not at home to receive your parcel it will be held at your Post Office for an amount of time. Items not collected from the Post Office will be returned to sender.

In the event that this occurs Marchand Medieval customer service will contact you. Cost of resending the parcel must be met by the customer. If a refund is requested then this will be for the goods only and not the shipping costs.



Parcel delivered in poor condition :

Check the parcel on receipt; if there is a problem with the condition the parcel should be refused and this should be indicated on the delivery note as ‘refused parcel because of damage’. E-mail Marchand Medieval as soon as possible to alert me to the situation.

If the parcel shows evidence of tampering or items are missing then it should be refused and a complaint lodged with the Post Office. Again e-mail Marchand Medieval of the situation so that any refund or exchange due can be made promptly.



Error of  address :

The personal information submitted by the buyer during the creation of an account and during the ordering process will be used for shipping: in the case of error in the address of the addressee, Marchand Medieval will be not responsible for difficulties in delivering the product.

If the parcel or the letter is returned to sender because of an incorrect address on the part of the customer, then once the error is rectified additional shipping charges will be payable by the customer to ensure delivery is made.

 

Article #4 : Marchand Medieval guarantees

 

The availability of articles :

- All items shown ‘in stock’ will be shipped on the working day (Monday – Friday) following payment. These should then be delivered in 5 working days after shipment.

Offers on the site are valid only while stocks last.

The majority of products listed on Marchand Medieval website are available in stock.

If, by error, one or several ordered products were not in stock and listed as ‘in stock’ I shall contact you to cancel or modify your order.

The prices appearing on this website are indicated in euro, dollars or pounds.
Prices include VAT except delivery expenses, and can vary in the course of the year.

Products remain the property of Marchand Medieval until completion of payment.

 

Right of cancellation/return of goods :

According to the code of ‘sale of goods’ in your countries, you have a time limit in which to return an article which does not meet your expectations.


In case of cancellation/return of goods, Marchand Medieval will make a refund to pay off your returned order (within 1 month), in the form of a credit (to be spent on the site on a future order) or in the form of a monetary refund. Refunds will be based on the condition of the returned goods; a full refund for goods returned as sent.

If you have benefited from free shipping, Marchand Medieval will refund the cost of goods minus the shipping costs.

There is currently no statutory right of withdrawal for distance selling to consumers in Switzerland.


How to exercise your right of cancellation/return of goods ?

See above for the deadline period of your countries: the deadline runs from the day you receive the goods and up to the dispatch date indicated on the return parcel.


Articles should be returned in the original packing, unworn/unused, with a photocopy of the invoice with the reason for returning.


The refund of the total amount of the order is made in thirty days following the arrival of the goods. The expenses of return postage are chargeable to the customer.

The law of cancellation/return of goods does not work in the following cases:

An article having been damaged through use or wearing , in the case of clothing, cannot be the subject of a refund.

In this case the customer is liable for all shipping costs.

Items that are custom made: embroidered to order or adjusted to size (belt holes) are not subject for refund.

Legwraps lengths under 6 metres are not subject for refund.

Right of access, modification, rectification and deletion:
The customer has (article 34 of the law of January 6th, 1978) a right of access, modification, rectification and deletion of the data which concern him.


Guarantee of products :

Products are handmade and therefore variations from item to item are to be expected; the items are not bound by guarantee.

 

The vegetable dyes :

The vegetable dye is fragile and is not as long-lasting as chemical colours.
Colours stemming from a vegetable dye made in a cauldron are unique, not reproducible and irregularities of tone (paler or darker shades) can be present on the same part of the textile because of the method of hand-made work.
By buying a textile dyed in vegetable dye, you accept the constraints due to the nature of this process.


Conditions of use to protect your colours longer:
Wash in the hand in a temperature of 30-40°C maximum.
Never use washing powders or soaps containing bleaching agents. Use a hand wash liquid.
Dry out of direct sunlight.

 

Article #5 : Validity of the order

 

Once your order is placed, an acknowledgement of receipt confirming your order will be sent to you using the email provided during the ordering process.

Receipt of the confirmation email indicates your order has been accepted.

By ordering you accept the terms and conditions of sale as stated on the website.

The conditions of sale can be altered at any time and without advance notice. The terms and conditions of sale applicable are the ones that are on the website at the time of ordering.

Marchand Medieval reserves the right to refuse any order from a customer with whom there have been previous disputes concerning the payment.

Terms and conditions are not available in all languages but are still valid nonetheless.

 

Article #6 : Applicable Law

 

All the articles appearing in these current general conditions of sale, as well as all the operations of sale which are aimed at it, are subjected to the French law. In case of dispute, the matter will be handled by Bourges commercial court in France.

 

Article #7 : Invoicing

 

From your validated order, you will receive an invoice by email as a PDF. This invoice states all the items ordered as well as postal charges. To save the paper and the environment, the electronic invoice is the preferred solution chosen by Marchand Medieval.
